Employers are Ahead of the Health Insurance Laws

Right now, the federal government doesn’t recognize same-sex marriages. However, a few states, and plenty of businesses, do recognize it when it comes to employer sponsored health insurance benefits. This is one situation where employers are ahead of the health insurance laws. The Defense of Marriage Act, or DOMA, was passed in 1996 and was signed into law by President Bill Clinton. This week, Maryland became the eighth state to legally allow same-sex marriage. Whenever two people get married, it leads to changes in the insurance policies of both partners. HealthCare.gov is a resource that everyone can use in order to find affordable health insurance options, including newly married same-sex couples. Court Rules Same-Sex Spouse Can be Covered by Health Insurance

A woman filed a lawsuit after her employer refused to allow her to cover her same-sex spouse on her health insurance policy. Her employer was the United States Government. A court ruled that she should be allowed to cover her same-sex spouse on her employer sponsored health insurance. Massachusetts, Connecticut, Iowa, Vermont, New Hampshire, New York, and the District of Columbia are states that issue marriage licenses to same-sex couples. ACLU Fights Michigan Domestic Partner Health Insurance Ban

Michigan recently passed a law that prevents public entities from providing health insurance for the same-sex domestic partners of employees. The ACLU is fighting this law on behalf of school teachers and city and county workers whose domestic partners will lose their health insurance coverage as a result of this law.
